What You Need to Know
The unit you own and are planning to sell or rent is defined and controlled by the Thorwald Condominum Trust Declaration, and the Thorwald Condominium Master Deed, both of which are accessible on this website under Condo Documents.
Rental Restrictions
The minimum rental period at Thorwald is one month. An owner may rent the Unit a maximum of three (3) times in any one-year period. A rental may be to a single family unit for residential purposes only. No commercial activity or parking of commercial vehicles is allowed on Thorwald property.
Alll renters are required to carry Renters Insurance for both property damage and liability naming the Thorwald Condominium as an additional insured. Owners are required to provide a copy of the current Thorwald Rules and Regulations to the Tenant and to confirm that the above conditions have been included in the rental agreement.
The owner must submit a Rental Information Form for every rental prior to occupancy by the tenant(s). Feel free to contact the Trustees for additional information using the Thorwald Trustees Contact Form.
Right of First Refusal
One right given to the Thorwald Trustees by the Master Deed that affects every potential sale, or a lease longer than one (1) year, is the Right of First Refusal (ROFR). You must first offer to sell your unit to the Condominium Trust on the same terms and conditions as any bone fide offer you get. If the Trustees do not accept this offer within thirty (30) days you are then free to proceed with your original sale. If you can’t wait this long, you may request an explicit waiver of this right by the Trustees. In any case, you will receive a notarized waiver document you may file with the Essex County land records.
Note that, as of 2025, Lenders are asking for proof of waiver of the Right of First Refusal not only for the pending sale, but also for the purchase of the unit by the current owner. This should have been sought and filed at the time of purchase, but if you are unable to locate it, the Trustees have executed a blanket waiver for all purchases prior to October 15, 2025 that is AVAILABLE HERE ON OUR WEBSITE.
You can provide notice of a sales offer and satisfy you obligation to offer to sell to the Trust by using THIS Online Owner Form. You should check the boxes to request an explicit waiver document and a 6D Certificate at the same time.
Condominium Documents and Information
Your sales agent, buyer agents, mortgage brokers, and other parties involved in a potential sale may want more details about the Thorwald Condominium. Our Condo Website HERE contains the basic condominium documents and well as plat and building plans for the facility. Refer interested parties to the website first., before asking the Trustees for something.
As an owner, you have gotten copies of other documents by email each month. These include monthly budget reports and Minutes of the Annual Meeting and all Trustee Meetings (typically every 2-3 months). You also got a copy of the Thorwald Master Insurance Declaration each year in November when the policy is renewed. You are responsible for providing this information to parties who need it for your unit sale. You may request it again from the Secretary if you lost it, but please be clear about what you need.
Public Information
There may be other information your buyer or third parties would like to know, such as if any one party owns multiple units or how many units are owner-occupied vs rented. The Gloucester Assessor Office (Currently Online Here) is a good place to start. The Thorwald Trustees only have rental and occupancy information as provided voluntarily by owners, and thus cannot provide “official” answers to these types of questions.
